According to wills and estate law, when a loved one passes away, their property will be distributed according to their will or, if they never made a will, according to the Wills, Estates and Succession Act (WESA). The process of administering the deceased’s estate can often be complex. The proper forms must be filed with the court registry. Notice must be given to specific persons. It can be helpful to work with an estate planning lawyer.

Complicating matters further, wills can often be contested. Beneficiaries can contest a will if the will-make was subject to undue influence or if the will was not properly executed. Children and spouses who have been disinherited are permitted to apply to “vary” the terms of the will and receive a larger share. Estate litigation is often complicated and emotional for all those involved.
